By accessing or using Nouna's marketing platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Nouna provides an AI-powered marketing platform that enables users to:

Generate marketing copy and content using artificial intelligence
Create and edit product images
Manage marketing campaigns across multiple platforms
Analyze marketing performance and analytics
Integrate with third-party platforms and services

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

4. Subscription and Billing

Nouna offers various subscription plans with different features and credit limits:

Free Tier: A limited monthly credit allowance for evaluating the platform. Free-tier credits do not roll over between months.
Paid Plans: Monthly credit allocations that scale with the plan. Unused paid-plan credits roll over to the following billing period.
Agency Plans: Full platform access with higher limits and additional brands.

Subscriptions are billed in advance on a monthly or annual basis. On paid plans, unused credits roll over month to month; free-tier credits do not roll over. Refunds are provided in accordance with our refund policy.

5. User Content

You retain ownership of content you upload to Nouna ("User Content"). By uploading content, you grant us a license to use, store, and process it to provide our services.

You represent that you have the necessary rights to upload your content and that it does not violate any third-party rights or applicable laws.

6. AI-Generated Content

Content generated by our AI tools is provided "as is." You are responsible for:

Reviewing all AI-generated content before use
Ensuring generated content complies with applicable laws and regulations
Verifying accuracy of any claims or statements in generated content
Obtaining necessary rights for any third-party materials referenced

7. Prohibited Uses

You agree not to use the Service to:

Generate illegal, harmful, or misleading content
Infringe on intellectual property rights
Distribute malware or conduct phishing attacks
Harass, abuse, or harm others
Circumvent usage limits or security measures
Resell or redistribute the Service without authorization
Generate content that violates advertising platform policies

8. Third-Party Integrations

The Service allows integration with third-party platforms (Facebook, Shopify, Google, etc.). Your use of these integrations is subject to the respective platform's terms of service. We are not responsible for third-party services or their availability.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Nouna and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Nouna shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time through your account settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
